Prosecutor Says His Mistakes Don't Absolve Death-Row Inmate
10/12/2005, 4:13 p.m. ET COLUMBUS, Ohio (AP) ? The state's top death-row prosecutor says today that the misstatements he made in a condemned inmate's case don't affect the man's guilt. Deputy Attorney General Timothy Prichard admits he made mistakes in a clemency hearing in August for inmate John Spirko. But he says the evidence is still overwhelming that Spirko killed a postmistress in northwest Ohio in 1982. The 59-year-old Spirko received a two-month reprieve by Gov. Taft following reports that the state presented inaccurate information at his first clemency hearing. His execution is now set for November 15th. Today's second clemency hearing is the first rehearing granted by the Ohio Parole Board since the state resumed executions in 1999.
